Abstract

Ijarah multi jasa financing is one of the rental contract-based financing products offered by Bank Pembiayaan Rakyat Syariah (BPRS). Ijarah multi jasa finance services that cannot be done through murabahah financing (buying and selling) or mudharabah financing (cooperation). This financing contract can finance a wide range of objects. The wide range of objects that can be financed through multi-service ijarah contracts raises concerns. Can an ijarah multi jasa contract be used to finance all objects? Is BPRS's ijarah multi jasa financing in accordance with Fatwa Fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI) No.44/DSN-MUI/VIII/2004? Research methods employ qualitative field research with an empirical research approach. According to the findings of this study, the analysis of ijarah multi jasa contracts at BPRS includes three components: analysis of financing objects, analysis of wage calculations (ujrah), and analysis of the accuracy of contract use. (1) An examination of financing objects on ijarah multi jasa contracts reveals the existence of multiple objects in BPRS, both based on criteria for work benefits (ijaratul 'amal) and benefits issued from objects (ijaratul 'ayan). Should the contract's object be limited to the ijaratul 'amal criteria. (2) The calculation of wages (ujrah) in ijarah multi jasa contracts at BPRS uses percentages rather than nominal amounts. Nominal should be used. (3) The accuracy of the use of ijarah multi jasa contracts in BPRS was discovered to be wakalah contract in one of the three models of realization of ijarah multi jasa contract financing. The use of wakalah in the financing of ijarah multi jasa contracts is not appropriate.
